This website is operated by ForaviNYC (“ForaviNYC,” “we,” “us,” or “our”). By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms and policies referenced herein (including our Privacy Policy and Return & Refund Policy).

If you do not agree to these Terms, you may not access the website or use the Service.

Our store is hosted on Shopify Inc., which provides the ecommerce platform that allows us to sell products and services to you.

SECTION 1 — ONLINE STORE TERMS

By using this Site, you represent that you are at least the age of majority in your jurisdiction. You must be at least 18 years old to opt in to SMS/text messages.

You may not use our products or the Service for any illegal or unauthorized purpose, or violate any laws in your jurisdiction (including copyright laws).

Certain products may be available exclusively online and may have limited quantities.

We make reasonable efforts to display product colors and images accurately; however, we cannot guarantee that your device’s display will accurately reflect the product.

We reserve the right to:

Limit sales to any person, region, or jurisdiction
Limit quantities per order/person/household
Discontinue products at any time
Correct pricing errors and cancel orders impacted by such errors (with notice)

Returns and refunds are governed by our Return & Refund Policy. Return shipping costs are the customer’s responsibility unless the item is defective, damaged, or incorrect.

SECTION 6 — SHIPPING, IN-STORE PICKUP, LOCAL DELIVERY, AND INTERNATIONAL ORDERS

A. Shipping

If shipping is offered for an order, estimated delivery windows are provided at checkout or in your order confirmation. Delivery dates are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or other events outside our control.

B. In-Store Pickup

If in-store pickup is offered at checkout, you will receive a notification when your order is ready. You may be asked to present your order confirmation and valid identification. Pickup timing and availability may vary. Orders not picked up within a reasonable timeframe may be canceled and refunded in accordance with our policies.

C. Local Delivery

If local delivery is offered at checkout, delivery windows are estimates and may vary due to traffic, weather, and operational constraints. You are responsible for providing accurate delivery details and ensuring access for delivery, including building access instructions where needed.

D. Address and contact accuracy

You are responsible for providing accurate shipping/delivery information and a valid contact method. We are not responsible for delays, non-delivery, or additional costs resulting from inaccurate or incomplete information.

E. International orders

International shipments may be subject to customs duties, taxes, and import fees assessed by the destination country. Unless stated otherwise at checkout, these charges are the customer’s responsibility. Customs processing may cause delays beyond our control.

SECTION 7 — ORDER, BILLING, AND ACCOUNT INFORMATION

We reserve the right to refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed under the same customer account, the same payment method, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we may attempt to notify you using the email and/or phone number provided at checkout.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information and to promptly update your information so that we can complete transactions and contact you as needed.

If an order is returned to us due to an incorrect address, failed delivery, or unclaimed pickup, we may cancel the order and issue a refund in accordance with our policies, minus any non-refundable shipping or handling costs where applicable.

We may provide access to third-party tools or content “as is” and “as available” without warranties or endorsements. Your use of such tools is at your own risk.

SECTION 11 — SMS / TEXT MESSAGING TERMS

If you opt in to receive SMS/text messages from ForaviNYC, you agree to receive SMS messages for customer support and transactional notifications related to your requests, reservations/appointments, orders, deliveries, returns, and service updates.

Message frequency varies (up to 4/month). Msg & data rates may apply.

Opt-in: You opt in by submitting a form on our website that includes an unchecked SMS consent checkbox (or another clearly disclosed opt-in method such as texting a keyword). You may receive a confirmation message after opting in.

Opt-out: Reply STOP to unsubscribe at any time. You may receive one final message confirming your opt-out. You can also reply START to re-subscribe (where supported).

Obligations and liabilities incurred before termination shall survive termination.
